Pursuant to Law No. 633 of April 22, 1941 ("Copyright Law") and subsequent amendments, particularly Articles 1 and 2, every creative work of an intellectual nature belongs to the author and is protected from its creation, regardless of formalities.

Pursuant to Articles 12 et seq. of the same law, the owner has the exclusive right to exploit the work for commercial purposes in any form and manner. Therefore:

  • Any unauthorized use may result in civil and criminal liability (Articles 171 et seq. of Law 633/1941).

At the European level, the provisions of Directive 2001/29/EC ("InfoSoc"), transposed in Italy, apply. This Directive protects authors' rights and establishes the principle of prior authorization for any act of reproduction or communication to the public.
